I have convictions that are more than 20 years old

by Adogzheart on November 1, 2009

Q:

I am applying for jobs but I think my past convictions are getting in the way. What can I do to get rid of them? Shouldn’t they be gone by now?

Jason

A:

Hello Jason,

This is a common question I get. Unfortunately, criminal convictions do not disappear with time. Because the processes of sealing records or expungement vary from state to state, they may be viable options for some ex-felons but not others. For example, in the state of New Jersey, where I live, one is allowed only one felony conviction and even that cannot be applied for until ten years from the completion of the sentence has passed. So if you finished your prison time and your probationary period, you cannot apply until ten years after the completion of probation.

Most people who apply for records to be sealed, seek qualified counsel because the application process can be a bit confusing and there is quite a bit of paper work involved.

Often the felon job search will entail some legal assistance. My advice is to contact your local legal aid office. Many legal aid offices will be able to offer low-cost or even no-cost assistance in applying.

I hope this helps.
